Terms of Service

Please read these Terms and Conditions ("Terms," "Terms of Service") carefully before using the Goodness app (the "App") operated by Cosvire ("us," "we," or "our") and our website https://bibleapp.cosvire.com.

Your access to and use of the App is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who access or use the App.

By accessing or using the App, you agree to be bound by these Terms. If you disagree with any part of the terms, then you may not access the App.

1. Accounts

When you create an account with us, you must provide us with information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate termination of your account on our App.

You are responsible for safeguarding the password that you use to access the App and for any activities or actions under your password, whether your password is with our App or a third-party service. You agree not to disclose your password to any third party. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account.

You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you without appropriate authorization, or a name that is otherwise offensive, vulgar or obscene.

2. User-Generated Content

The Goodness app allows you to post content, including but not limited to, adding verses to favorites and submitting prayers to the Prayer Wall. You are solely responsible for the content you post, its legality, reliability, and appropriateness.

By posting Content to the App, you grant us a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, and sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such Content throughout the world in any media.

You represent and warrant that:

  • You own the Content you post on or through the App or have the right to grant the license as set forth in these Terms.
  • The posting of your Content on or through the App does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person.

We reserve the right, but not the obligation, to monitor and edit all Content provided by users. We are not responsible for the content of the App's users. You expressly understand and agree that you are solely responsible for the Content and for all activity that occurs under your account, whether done so by you or any third person using your account.

Content Restrictions

You may not transmit any Content that is unlawful, offensive, upsetting, intended to disgust, threatening, libelous, defamatory, obscene, pornographic, pedophilic, libelous, invasive of another's privacy, hateful, or racially, ethnically objectionable, disparaging, relating or encouraging money laundering or gambling, or otherwise unlawful in any manner whatever. Examples of such objectionable Content include, but are not limited to, the following:

  • Unlawful or promoting unlawful activity.
  • Impersonating any person or entity, including Cosvire and its employees or representatives.
  • Infringing on any proprietary rights of any party, including patent, trademark, trade secret, copyright, right of publicity, or other rights.
  • Violating the privacy of any third person.
  • False information and features.

We reserve the right to remove or refuse to display any Content that, in our sole discretion, is deemed inappropriate or violates these Terms. We may also make formatting and edits and change the manner of any Content.

3. Subscriptions and Payments

The Goodness app may offer premium features or an ad-free experience through subscriptions. All payments for these subscriptions are processed exclusively through the payment channels provided by Google Play (for Android users) and Apple App Store (for iOS users).

  • No Direct Payment Collection: We do not directly collect, store, or process any of your payment details, credit card numbers, or other financial information. This information is handled entirely by Google Play and Apple App Store.
  • Billing and Renewal: Billing, subscription management, and auto-renewal are governed by the terms and conditions of Google Play and Apple App Store. Please refer to their respective terms for details on payments, cancellations, and refunds.
  • Opting Out of Ads: If you choose to subscribe to the App, you will opt out of ads that may be implemented in the future.

4. Intellectual Property

The App, its original code, design, user interface, features, and functionality are and will remain the exclusive property of Cosvire and its licensors. The App is protected by copyright, trademark, and other laws of respective countries. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Cosvire.

Bible Content: The biblical content (text of various Bible translations) provided within the App is sourced from open-source or public domain versions and is not owned or licensed by Cosvire. Cosvire does not claim any copyright over the original biblical texts themselves. Your right to use, reproduce, or distribute the biblical texts is subject to the terms of their respective open-source or public domain licenses.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial use, strictly in accordance with these Terms.

5. Links To Other Websites

Our App may contain links to third-party websites or services that are not owned or controlled by Cosvire.

Cosvire has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that Cosvire shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods or services available on or through any such web sites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

6. Termination

We may terminate or suspend your account immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms.

Upon termination, your right to use the App will immediately cease. If you wish to terminate your account, you must contact us via email at goodness@cosvire.com to request account deletion. We will delete your account and all associated data within thirty (30) days of receiving your email request.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

7. Indemnification

You agree to defend, indemnify, and hold harmless Cosvire and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the App, by you or any person using your account and password; b) a breach of these Terms, or c) Content posted on the App.

8. Limitation of Liability

In no event shall Cosvire, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of, or inability to access or use, the App;
  • Any conduct or content of any third party on the App;
  • Any content obtained from the App; and
  • Unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence.md), or any other legal theory, whether or not we have been informed of the possibility of such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

9. Disclaimer

Your use of the App is at your sole risk. The App is provided on an "AS IS" and "AS AVAILABLE" basis. The App is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

Cosvire does not warrant that a) the App will function uninterrupted, secure, or available at any particular time or location; b) any errors or defects will be corrected; c) the App is free of viruses or other harmful components; or d) the results of using the App will meet your requirements.

10. Governing Law

These Terms shall be governed and construed in accordance with the laws, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our App, and supersede and replace any prior agreements we might have between us regarding the App.

11. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will try to provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our App after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the App.
